IMPORTANT NOTICE: Welcome to Heart&BP (hereinafter referred to as "the Application" or "we"). Before downloading, installing, or using the Application, please read and thoroughly understand these Terms of Service (hereinafter referred to as "these Terms").
By clicking "Agree", "Accept", or by otherwise accessing and using the Application, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree with any part of these Terms, do not download, install, or use the Application.
1. Scope of Services & Product Orientation
1.1 Heart&BP is a fitness, wellness tracking, and efficiency mobile utility designed to assist users with daily pulse tracking, blood pressure logging, physiological data visualization, and general lifestyle guidance.
1.2 Core features include, but are not limited to, extracting photoplethysmogram (PPG) signals via the device's built-in camera sensor to estimate pulse rates, providing manual entry logs for blood pressure tracking, generating metric charts, and offering native integration with Apple HealthKit for data synchronization.
2. Medical Disclaimer (Critical Term)
2.1 Non-Medical Device Status: Heart&BP is intended solely for general fitness, athletic tracking, and personal wellness monitoring. The Application is NOT a medical device.
2.2 No Medical Advice: Any information, data estimations generated by the camera, blood pressure logs entered by the user, statistical graphs, analysis charts, and generic automated health feedback provided within the Application do NOT constitute medical advice, clinical diagnoses, medical screening, preventive assessments, or explicit treatment plans. They must never replace a face-to-face consultation, physical evaluation, or clinical diagnosis by a licensed physician.
2.3 Information and Measurement Variance: Due to inherent physical limitations of mobile phone camera hardware, variations in ambient lightning conditions, individual skin melanin levels, and user posture, heart rate estimations may fluctuate or contain errors. All measurements and data logs are for personal tracking reference only and must never be used to modify prescription medication dosages or assess acute cardiovascular emergencies.
2.4 Emergency Situations: If you feel physically unwell, experience chest pains, or suspect you are experiencing severe hypertensive or arrhythmic symptoms, you must immediately stop using the Application and seek professional clinical care, or contact your local emergency services (e.g., 911 or local emergency numbers) immediately. We assume no legal liability for any personal injury, health degradation, or financial loss resulting from reliance on the software over proper medical intervention.
3. User Account & Device License
3.1 We grant you a personal, non-transferable, non-exclusive, revocable, and limited license to download, install, and execute Heart&BP on a legitimate, uncompromised iOS device owned or controlled by you for personal, non-commercial purposes.
3.2 You are solely responsible for maintaining the physical and digital security of your device. Any local data leaks, alterations, or performance degradation resulting from device loss, unauthorized hacking, jailbreaking, or malware exposure shall be borne entirely by you.
4. Code of Conduct
4.1 You agree to use the Application in a lawful, ethical, and reasonable manner. You shall not utilize Heart&BP for any activities that violate applicable local, regional, or international laws, disrupt internet architecture, or infringe upon the proprietary rights of others.
4.2 You are strictly prohibited from reverse engineering, decompiling, disassembling, or otherwise attempting to extract the underlying source code, mathematical algorithms, or interface mechanics of the Application. You may not modify, lease, distribute, or commercially exploit any elements of the software.
5. Privacy Protection
5.1 Guarding your personal and health information privacy is a cornerstone of our development values. We commit to collecting, handling, storing, and securing your personal information in strict compliance with the Heart&BP Privacy Policy, which is presented alongside these Terms and forms an integral part of this legal agreement.
5.2 To reiterate, any data explicitly shared by you via Apple HealthKit is retained locally or securely within your personal iCloud ecosystem. We absolutely do not stream, exploit, or sell your HealthKit data to third-party ad networks, commercial entities, or information brokers.
6. Intellectual Property Rights
6.1 All legal rights, titles, and interests in and to the Heart&BP application, including its graphical user interfaces, text elements, interactive designs, branding assets, source code, and associated copyrights are exclusively owned by the Application's developer and are protected by international copyright, trademark, and intellectual property statutes.
6.2 Without our express prior written permission, you may not copy, replicate, mimic, alter, or utilize any of our intellectual property assets for commercial or public purposes.
7. Service Modifications, Interruptions, & Termination
7.1 In order to optimize user experience, we reserve the right to deploy automated patches, software upgrades, scheduled maintenance, or modify operational modules at our sole discretion. Such actions may lead to temporary software interruptions, and you acknowledge that we bear no liability for such technical pauses.
7.2 If you violate any provisions of these Terms or engage in behavior that compromises the structural security of our product environment, we reserve the right to suspend, restrict, or entirely terminate your access to the Application without prior notice or liability.
8. Warranty Disclaimers & Limitation of Liability
8.1 The Application is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to warranties of accuracy, data reliability, continuous uptime, absolute security, or fitness for a particular health tracking goal.
8.2 In no event shall we be liable for any direct, indirect, incidental, punitive, special, or consequential damages (including, but not limited to, loss of profits, delayed medical diagnostics, data loss, corruption, or business interruption) arising out of or connected with the use or inability to use the Application, even if we have been advised of the possibility of such damages.
9. Amendments & Updates
9.1 We reserve the right to modify or adjust these Terms periodically due to product advancements, shifting compliance guidelines, or legal updates. Revised terms become legally effective immediately upon being published inside the app or on official distribution channels. Your continuous use of the Application following an amendment signifies your binding acceptance of the updated terms.
